This Privacy Policy describes the privacy practices of the Throw App Platform (the “Service”) operated by Throw App Co., a Delaware corporation (collectively, “Company” or “Throw App” or “we” or “us” or “our”), the Personal Data we collect about you, how we collect it, how we use it and with whom we share it. This Privacy Policy also describes the choices you can make about how we collect and use your Personal Data. This Policy does not apply to the practices of companies that we do not own or control, or to people whom we do not employ or manage.
By using or interacting with the Service, whether on our web application or on our mobile device app, you agree to the collection and use of information in accordance with this Privacy Policy. This Privacy Policy is subject to and incorporated within the Service’s Terms of Service (“Terms”), including its provisions on liability and dispute resolution. Capitalized terms not otherwise defined in this Privacy Policy shall have the meanings ascribed to them in the Terms.
Cookies. Cookies are small pieces of data stored on your device (computer or mobile device).
Data Controller. Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any Personal Data are, or are to be, processed. Through third party tools used to collect User behavior, such as through Cookies. We may also receive reports based on the use of these technologies from our Service Providers on an individual as well as aggregated basis.
We collect different information from you depending on how you engage with us.
We collect your email address and any other information you provide to us when signing up to use the Service.
We collect your identifiers and biographical information, such as your name, date of birth, gender education and professional background information, geographical location (zip code), and any other information you provide to us when you set up your account on the Service.
Third parties may collect financial information, such as your credit or debit card numbers, to facilitate our [Subscription Service / Premium Plan] payments, but we do not receive or process your financial information. That information stays with our third party service providers.
We collect your association with Throws (questions) and Catches (answers) on our Service when you participate in the Service and generate Throws, answers, like or dislike answers and boost answers.
We automatically collect Usage Data through your use of the Service.
We collect information and inferences regarding your personality, interests and expertise traits when you participate in the Service.
We collect lead generation data and track marketing campaign effectiveness from information from third parties, including advertising partners.
We may process and use your Personal Data primarily to perform a contract with you, and to otherwise deliver the Service or a service that you request, including:
To create your account and authenticate you.
To fulfill your requests to initiate or respond to Throws or to re-publish your responses to Throws pursuant to a report of offensive comments.
To associate you with the Throws and answers that you initiate, respond to, like, dislike or boost.
To address reports of offensive comments.
To associate your account with the Score determined by the Service.
To assist us in operating and improving the Service, including to anonymize, deidentify and aggregate your Personal Data, following which processing it will no longer be considered Personal Data.
To enhance your profile on the Service in order to optimize matching you with relevant Throws that match your expertise.
We may also process your Personal Data because it is necessary for our or a third party's legitimate interests and it’s not overridden by your rights. In this respect, we may use your Personal Data to:
To contact you via email, postal mail, or telephone to learn more about your preferences, to conduct market research and learn more about how we can improve our offerings.
To contact you to obtain additional information and assist in the resolution of a report of offensive comments.
To track Service performance, to make your visit better, and for aggregate Service analytics.
To analyze trends, measure page views and performance, administer the Service, track Users’ movements around the Service and to gather demographic information about our User base as a whole.
We use Cookies and LSOs to remember Users’ preferences (e.g. search filters), for authentication, for source tracking, for analytics, or for product recommendations.

To show you surveys you may qualify for.
To better match Throws to Users providing answers that may have relevant or specific expertise in order to increase the quality of answers. In providing this matching service, we use large language models based artificial intelligence (AI) chatbot technologies.
We may also process your Personal Data for our compliance with our legal obligations. In this respect, we may use your Personal Data for the following:
When necessary to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by us, whether or not a response is required by applicable law.
When necessary to enforce or apply our Terms and other related agreements.
To protect our rights or the property or safety of our employees, Users or members of the general public.
You may also choose to share your Personal Data with survey companies through our Service. Our Service uses Pollfish SDK. Pollfish is an on-line survey platform, through which, anyone may conduct surveys. Pollfish collaborates with Publishers of applications for smartphones in order to have access to users of such applications and address survey questionnaires to them. When a user connects to this app, a specific set of user's device data (including Advertising ID, Device ID, other available electronic identifiers and further response meta-data is automatically sent, via our app, to Pollfish servers, in order for Pollfish to discern whether the user is eligible for a survey. For a full list of data received by Pollfish through this app, please read carefully the Pollfish respondent terms located at https://www.pollfish.com/terms/respondent. These data will be associated with your answers to the questionnaires whenever Pollfish sends such questionnaires to eligible users. Pollfish may share such data with third parties, clients and business partners, for commercial purposes. By downloading the application, you accept this privacy policy document and you hereby give your consent for the processing by Pollfish of the aforementioned data. We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data. If you wish to be informed what Personal Data we hold about you and if you want it to be removed from our systems, please contact us using the details set out below. You may have the right to:
Access or update the information we have on you. Find out if we use your Personal Data, access your Personal Data and have it corrected or amended if it is inaccurate or incomplete.
Withdraw consent. Withdraw any express consent that you have provided to the processing of your Personal Data at any time without penalty.

Opt-out of targeted or behavioral advertising. You may have the right to opt out of cross-context behavioral / targeted advertising, which is based on the Personal Data you share with our Service, as well as data collected from third party websites.

You additionally have choices regarding the collection, use, and sharing of your Personal Data.
You have a right at any time to stop us from contacting you for promotional marketing purposes. If now or in the future you receive promotional or electronic newsletter communications from us, you may indicate a preference to stop receiving such communications from us, and you will have the opportunity to “opt-out” by clicking the “Unsubscribe” hyperlink at the bottom of all such communications. Notwithstanding your indicated email marketing preferences, we may continue to send you administrative emails regarding the Service, including, for example, order confirmations or updates to our Privacy Policy or the Terms.

Our Service is intended for users within the U.S. We store and process all Personal Data within the U.S.
